Uzbekistan has introduced a formal procedure to compensate citizens who suffer financial losses due to fraudulent online loans and microcredits. Under the new regulations, once a person is officially признized as a victim, their obligations related to the fraudulent loan are suspended, and any previously deducted funds must be returned.
How does the process begin?
If a citizen discovers that a microloan has been illegally issued in their name, they must file a заявление with internal affairs authorities. This initiates a pre-investigation check, inquiry, and preliminary investigative actions.
How is victim status confirmed?
When the investigation confirms that the loan was obtained through fraud, an investigator, prosecutor, or court issues an official document recognizing the individual as a victim. This document is then sent to the credit organization that processed the loan.
What actions must the credit organization take?
Upon receiving the document, the credit organization is required to immediately stop начисление interest, penalties, and fines on the loan. It must also halt all collection activities against the victim.
Are deducted funds refunded?
Yes. If any funds were previously withdrawn from the individual to cover the loan or related payments, they must be refunded to the victim’s bank card or specified account based on a court ruling. The refund must be completed within 15 days after the court decision comes into force.
How are lenders protected?
If a credit organization questions the legitimacy of the fraud claim, it has the right to appeal the investigation results or court decision and request a review. If no fraud is confirmed upon re-examination, the organization can resume loan accrual and collection.
How is damage recovered from the actual fraudster?
To recover losses, the credit organization may participate in the investigation and court proceedings as a civil plaintiff. Once the offender is identified, the lender can file a claim to recover damages directly from the responsible individual through recourse.
